Terms of Use

About these terms

This website is operated by Validatora Ltd, a company registered in England and Wales with company number 17383976, whose registered office is at 55 Loudoun Road, London NW8 0DL. In these terms, “Validatora”, “we” and “us” mean Validatora Ltd.

These terms set out the basis on which you may use this website. By using it you accept them. If you do not agree with them, do not use the website.

They should be read together with our privacy policy, which explains how we handle personal data, and our legal notice and disclaimer, which explains the limits of what our scores and rankings mean.

Who the website is for

This website is intended for people acting in the course of a business or profession, not for consumers. By using it you confirm that you are at least 18 and are using it in a business capacity.

If you are using the website on behalf of an organisation, you confirm that you have authority to accept these terms for that organisation, and “you” then means the organisation as well as you personally.

You may not use the website, ask for access or hold an account if you or your organisation are subject to financial or trade sanctions imposed by the United Kingdom, the European Union, the United States or the United Nations.

What this website is

This website describes Validatora and its products. Validatora is in limited release. Some of the features described here are shown as illustrations, and some are not yet generally available.

Nothing on this website is an offer to supply a product or service. Access to the product is granted separately, at our discretion, and may be subject to a separate agreement.

Information only, not advice

The content of this website, and any scores, rankings or analysis we produce, are provided for information and research purposes. They are measures of past forecasting performance. They are not a prediction of future performance.

Nothing on this website is investment advice, investment research, a recommendation, or any other form of financial, legal or tax advice. You are responsible for your own decisions and for deciding how much weight, if any, to give to anything you read here.

Using the website

You may use this website for lawful purposes only. You must not:

  • copy, scrape or systematically extract content from it, whether by a bot, crawler or any other automated means, or by hand;
  • use the website or anything on it to develop, train, fine-tune or test any artificial intelligence or machine learning system, or carry out text or data mining on it for any purpose;
  • attempt to work out or reconstruct the methods by which our scores and rankings are produced, or create anything derived from them;
  • attempt to gain access to any part of the website, or to any account or data, that you are not authorised to use;
  • interfere with the operation of the website, or introduce anything harmful to it;
  • give false details when you contact us or ask for access, or pretend to be someone else;
  • use the website in any way that breaks the law or infringes the rights of anyone else.

The restrictions on automated access and on text and data mining are an express reservation of our rights, including for the purposes of any law that allows such activity unless rights are reserved.

You may link to our home page, provided you do so fairly and do not suggest that we endorse or are associated with you when we are not.

If you do not keep to these terms we may suspend or withdraw your access, refuse an access request, and take any other steps we consider appropriate, including legal action.

Requesting access and accounts

Sending us an access request does not create a right to access. We decide whether, when and on what basis to offer it.

Where we give you an account, you must keep your sign-in details confidential, must not share them, and must tell us promptly if you think someone else has used them. You are responsible for what is done through your account.

If you have a separate written agreement with us for the product, that agreement takes priority over these terms wherever the two differ.

Intellectual property

We own, or have the right to use, everything on this website, including its text, design, graphics, logos, scores, rankings and the methods and data behind them. These are protected by copyright, database right and other intellectual property rights, and all of those rights are reserved. The name Validatora and our logo are ours.

You may view the website for your own internal business purposes and share links to it. You may not reproduce, republish, sell, license or otherwise make commercial use of its content, or pass it to anyone outside your organisation, without our written permission.

Where we do allow you to quote or reproduce anything, you must credit Validatora as the source and must not remove any copyright or other notice.

If you send us suggestions or feedback about Validatora, we may use them freely to improve our products, without any obligation to you.

Names and trade marks of other organisations that appear on this website belong to their owners. We refer to them only to identify them, and doing so does not imply any connection with or endorsement by them.

Confidential material

We may make our methodology, or other material that is not on the public website, available to registered users and to people we are in discussions with. That material is confidential.

If we make any of it available to you, you must keep it confidential, use it only to evaluate or use Validatora, and not disclose it to anyone outside your organisation without our written permission. This obligation continues after you stop using the website.

Material you provide

Some features, such as Personal Rank, allow you to upload research or other material. You keep whatever rights you have in it. You allow us to store and process it for the sole purpose of providing that feature to you.

You are responsible for making sure you are entitled to upload the material and to have it processed in this way, including under any licence or terms on which it was supplied to you. If a claim is made against us because you were not entitled to do so, you will be responsible for it.

We do not use material you upload in any other product, and we do not make it available to other users.

Sources and links

Our work draws on forecasts and outcome data published by third parties. We do not control those sources and cannot guarantee that they are complete or free of error.

Where this website links to other websites, we are not responsible for their content.

Availability and changes to the website

We aim to keep the website available and its content accurate, but we do not promise that it will always be available, uninterrupted or up to date. We may change, suspend or withdraw any part of it without notice.

Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that, the website is provided as it is, and we give no warranty about its content. To the fullest extent the law allows, we are not liable for any loss of profit, revenue, business or opportunity, any loss of or damage to data, any loss arising from a decision made in reliance on the website, or any indirect or consequential loss, arising from your use of the website or your inability to use it.

Subject to the first paragraph of this section, our total liability to you in connection with the website and these terms is limited to £50. If you have a separate written agreement with us for the product, the limits in that agreement apply to the product instead.

We are not responsible for any failure or delay caused by events outside our reasonable control.

Changes to these terms

We may update these terms from time to time. The date at the top of the page shows when they were last changed. By continuing to use the website after a change, you accept the updated terms.

General

These terms, together with the documents they refer to, are the whole agreement between you and us about your use of the website.

We may transfer our rights and obligations under these terms to another organisation. You may not transfer yours without our written consent.

If we do not enforce a right, or delay in doing so, that does not mean we have given it up. If any part of these terms is found to be unenforceable, the rest continues to apply.

Nobody other than you and us has any right to enforce these terms.

Governing law

These terms, and any dispute or claim arising from them or from your use of the website, including non-contractual claims, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.

Questions about these terms can be sent to enquiries@validatora.com or through the contact form. See also our privacy policy and our legal notice and disclaimer.
